Turnover Receivership Statue
The Texas Civil Practice and Remedies Code (known as the “Turnover” statue) becomes an integral part of the proceedings of property going into a receivership. Prior to the turnover, the burden is placed on the defendant to identify and produce its leviable property and related documents to the court, and, the trial court must determine that the elements have been satisfied before it enters a turnover order. Many collection attorneys are using the Receivership process to help collect their judgments, and as the laws have been amended several times because of concealed property and inadequate collection methods, these new revisions have assisted many attorneys in recovering their judgments.
